Half Five — Terms of Use

1. Who you are agreeing with

Half Five is provided by Spark Curiosity Ltd, a company incorporated in Jersey, registered office [registered office from entity.md] ("we", "us"). By downloading or using Half Five you agree to these terms.

2. You must be 18

You must be at least 18 years old to create a Half Five account and to buy a subscription. Half Five is designed to be set up and paid for by an adult running a household. It is not for children to sign up to.

3. Setting up other people, including children

Half Five asks you to add the people you cook for, including their first names and the foods they must avoid.

You confirm that:

1. you have parental responsibility for any child you add, or the permission of someone who does;
2. you are entitled to give consent, on that child's behalf, to Half Five holding and using their allergy and intolerance information for the purpose of keeping unsafe meals off your card; and
3. for any adult you add who is not you, you have told them Half Five holds their name and the foods they avoid.

This matters. Allergy information is health data, and the only lawful basis we have for holding it is explicit consent. Where the person is a child, the consent has to come from an adult who is entitled to give it. If you are not that adult, do not add that child.

4. Half Five is not a medical or safety device

Read this part properly.

Half Five filters suggested meals against the avoidances you type in. It is a convenience, not a safety system, and you must not rely on it to keep anyone safe.

• Always read the actual ingredients and the actual packaging before you cook and before you serve.
• Recipes describe ingredients in ordinary language. Ingredients change, brands change, products get reformulated, and the same dish name means different things in different kitchens.
• We take reasonable care over the allergen information in our recipes, but we do not warrant it is complete or correct for every product you might buy.
• Half Five gives no dietary, nutritional or medical advice, and nothing in it is a substitute for advice from a doctor or a dietitian.

If someone in your household has a serious allergy, treat Half Five's suggestions as suggestions and check everything yourself.

5. Your subscription

Half Five is sold by subscription, in two forms:

• £39.99 per year, or
• £6.99 per month.

Both give the whole household access. New subscriptions include one week free. Because Apple grants introductory offers per subscription group, a free week taken on one of the two plans means the other plan does not carry one.

Apple is the merchant of record. You buy from Apple, Apple charges your Apple Account, and Apple's terms govern the payment. Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. Cancel or manage it in Settings › Apple Account › Subscriptions — we cannot cancel it for you.

Family Sharing is on. If you use Apple Family Sharing, the people in your Apple family can use your subscription without buying their own.

Refunds are handled by Apple, under Apple's policy, not by us.

6. What you may and may not do

You may use Half Five for your own household's cooking. You may add your own recipes and photographs.

You may not: resell or redistribute Half Five or its recipe content; upload anything you do not have the right to upload; upload anything unlawful, abusive or obscene; or try to break, probe or circumvent the app's security or another household's data.

Recipes and photographs you add stay private to your household unless you choose to submit one for review, in which case we may include it in the shared recipe corpus. Submitting a recipe grants us a licence to use and adapt it for that purpose. You keep ownership of what you wrote.

7. Your account and ending it

You can delete your account at any time in Settings › Delete account. If you are the last person in your household, that deletes the household's data too.

We may suspend or end an account that breaches these terms. If we do, we will tell you why, and Apple will handle any refund question.

8. Availability

We do our best to keep Half Five working, but we do not promise it will always be available or error-free. We may change or withdraw features.

9. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, and because Half Five is a low-cost consumer app rather than a professional service: we are not liable for losses that were not reasonably foreseeable, and our total liability to you in any twelve-month period is limited to what you paid us for Half Five in that period.

Nothing here affects your statutory rights as a consumer.

10. Changes

We may change these terms. If a change matters, we will tell you in the app before it takes effect. Continuing to use Half Five after that means you accept the change.

11. Law

These terms are governed by the law of Jersey, and the courts of Jersey have jurisdiction. If you are a consumer resident in the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of your own country, and you may bring proceedings in your local courts.
